Terms & Conditions
All bidders are bound to the terms & Conditions of this auction. All bidders are advised to read the Terms & Conditions of the auction before bidding with Rockabilly Auction Company LLC. All bidders are bound by the terms and conditions of the sale, as amended by any oral announcement or posted notices, which together form the contract of the sale between the successful bidder (purchaser), Rockabilly Auction Company and the seller (consignor) of the lot.
TERMS OF SALE
When bidding on any lot offered by Rockabilly Auction Company, the bidder indicates acceptance of the following terms of the sale. Any participation in the auction binds you to agreement of the terms whether or not you read or understand said terms.
Rockabilly Auction Company strives to accurately describe all items offered in our sales. This description is to be used as a guide. All items are sold ‘as is’ and it is the bidder’s responsibility (present or absentee) to determine the exact condition & value of each item for which a bid is entered. ASK QUESTIONS BEFORE YOU BID. Rockabilly Auction Company will not be held responsible for typographical errors. Neither we nor the consignor make any guarantees, warranties, or representation expressed or implied in regard to the property or correctness of the catalog or other description of the authenticity of authorship, physical condition, size, quality, rarity, importance, provenance, exhibition, literature or historic relevance to the property or otherwise. No statement anywhere whether oral or written, shall be deemed such a guarantee, warranty or representation. Prospective bidders should inspect the property before bidding to determine its condition, size, and whether or not it is original or has been restored. The consignor and Rockabilly Auction Company make no representation or warranty as to whether the purchaser acquires any reproduction rights in the property. Returns will not be accepted under any circumstances. Items will be available for preview by appointment.
All items are sold for display purpose. If electrical, mechanical, or other working parts are inoperable even if working at time of the sale Rockabilly Auction Company is not liable due to the inherent nature of the age of these antiques and items.
GAMING DEVICES
These items may be held for up to 5 business days so the state agencies can verify the purchaser’s information. All auction bidders are urged to check the legality of possession and/or shipment of gaming devices to their state of residence. Any gaming device purchased through Rockabilly Auction Company shall be used for the purposes of display or social entertainment within the private home or resident of the buyer. Such devices shall not in any event or manner be available to the public for the purpose of gambling.
BIDDING RIGHTS & RESPONSIBILITIES
The auctioneer will determine the highest bidder. Only the auctioneer has a right to reopen the bid should it deem necessary in the event of a tie bid on the floor. If there is a tie bid between the floor and internet bidder or absentee bid, the floor bid will take precedence. PLEASE NOTE: when placing an Internet prebid /absentee bid, the floor bidder can win the item at the same price if the auctioneer receives the floor bid before the online absentee bid is received.
Rockabilly Auction Company will use reasonable efforts to carry out online bids and do not accept liability for equipment failure, inability to access the internet, internet speed or software malfunctions related to the execution of online bids.
Rockabilly Auction Company and its representatives reserve the right to remove any attendees who impede preview and/or auction. Title of merchandise shall pass to the highest bidder at the fall of the auctioneers hammer or the auctioneer saying sold. The buyer will then assume all risk and full responsibility of the lot once ownership has changed. Items may be removed from the auction only after full payment is received by Rockabilly Auction Company.
Buyers Premium
22% buyers premium shall be added to the successful bid as part of the total amount due for online and phone bidders.
PAYING FOR ITEMS
A $10.00 TRANSPORT FEE will be added to each invoice requiring shipping. (This is only a transport fee to get your items to the shipper) Successful online bidders will receive an invoice no later than Monday after the close of the auction and must pay for items no later than the close of business on the 1st Tuesday following the auction. All credit cards on file with Live auctioneers will be processed 72 hours following the auction. Sales tax will be charged to invoices where required by law. If you are tax exempt, please upload your tax number to your bidder profile to avoid the sales tax. If you do not have a card on file with Live Auctioneers, Payments will be made online through Live auctioneers by clicking on the pay now button on your invoice. Rockabilly Auction Company will not accept online payments directly. No checks by mail will be accepted. All online payments be will processed through Live Auctioneers. All payments made by ACH through Live Auctioneers MUST CLEAR BEFORE ITEMS ARE REMOVED OR TAKEN TO THE UPS STORE.
PACKING/SHIPPING
When you pay your invoice through Live Auctioneers, you will be asked to choose a shipping option. Choose “Pick Up” if you are picking up your items or arranging for someone else to pick up your items. Choose “Self Arranged” if you want your items taken to the UPS store for shipping. It is the bidders responsibility to take packing & shipping costs into consideration when bidding on items. Packing, handling, shipping, and insurance charges are the FULL responsibility of the purchaser.
Rockabilly Auction Company will transport items to the UPS Store in Oakwood Ga. A $10.00 transport charge is due to Rockabilly Auction Company and will be added to your invoice. If someone is picking up your items please contact Rockabilly Auction Company ASAP to avoid the transport fee. ALL ACH PAYMENTS MUST CLEAR BEFORE ITEMS ARE REMOVED FROM OUR GALLERY. Purchasers will pay shipping & insurance charges DIRECTLY to the appropriate company doing the shipping. Any disputes & claims occurring from shipping issues will be handled between the shipper and the purchaser. Rockabilly Auction Company is not responsible for items once they have transferred ownership.
REMOVAL OF ITEMS PURCHASED
ACH payments must clear before items are removed from Rockabilly Auction Company. All purchased items must be removed from Rockabilly Auction Company within 14 days from the auction date in which the items were purchased. Unless alternate arrangements are made between the purchaser & Rockabilly Auction Company, any items remaining after 14 days will be considered abandoned and will become the property of Rockabilly Auction Company. If alternate arrangements with Rockabilly Auction Company have been arranged to store items past the 14 days, all items will be subject to a $10.00 per day storage fee after 30 days. Rockabilly Auction Company DOES NOT have storage space available to store purchased items.
Autopay
If you have not contacted Rockabilly Auction Company to arrange payment within 3 days of the time that invoice is sent, we will charge the credit card you used to register for the auction for the amount of your invoice.
SALES TAX
Online purchases from Rockabilly Auction Company may be subject to sales tax. If you are tax-exempt, you can submit your tax-exempt certificate to prevent the collection of tax.
IN-HOUSE TERMS
*Payment terms: A buyers premium will be added to all purchases as follows:

17% for absentee bids
16% for in house credit card
13% for in house cash & check purchases.
